Following the recent case of De Souza v Vinci Construction (UK) Ltd [2017] EWCA CIV 879, the President of the Employment Tribunal has issued new Guidance on Vento awards for injury to feelings and psychiatric injury. The new bands are applicable to claims presented after 6 April 2019 and are as follows:

 Lower band – £900 to £8,800 for less serious cases;
 Middle band – £8,800 to £26.300 for those cases that do not fit into the other bands;
 Upper band – £26,300 to £44,000 for the most serious cases.

The Tribunal is able to award a higher figure than the top of the upper band if it is one of ‘the most exceptional cases’.
