Regulatory
Alun is uniquely well-placed to provide robust and informed advice and representation in the regulatory sphere, having come to the Bar after a successful first career as HM Inspector for the Health & Safety Executive.
Alun was an Assessment Manager for ‘COMAH Top-Tier’ sites (chemical plants with the potential to cause catastrophic major accidents) and conducted fatal accident and major incident investigations together with the police under the ‘Work-related death protocol’.
A common theme in his work was the investigation of accidents and incidents and the subsequent preparation and conduct of prosecutions. This involved consideration of offences at the nexus of gross negligence manslaughter, corporate manslaughter and regulatory crime; an area in which he then furthered his expertise by undertaking a Master’s Degree in the field of Corporate Manslaughter.
Using the knowledge and skills built up over many years at the forefront of regulatory oversight, Alun has developed a heavyweight practice in regulatory matters and his skill has been recognised by way of appointment to the Specialist Regulatory List for advocates prosecuting Health & Safety and Environmental Law.
Alun is regularly instructed by agencies including the HSE, Environment Agency, Natural England and the Care Services Commission. He is also highly experienced in Trading Standards prosecutions where he both prosecutes and defends.
By virtue of his former profession, Alun has a deep and immediate grasp of Health and Safety legislation. In his previous role with the Health & Safety Executive, Alun’s work ranged from the regional Major Investigation Team, through to the construction and chemical Major Hazard sectors. This provided a broad expertise in a key area of Regulatory Crime, and also in relation to accidents at work and matters of occupational ill-health such as HAVS, MSD, Asbestos and Legionella. He is also well versed in the Construction (Design and Management) Regulations (CDM). As a consequence, Alun approaches cases with a unique perspective and an instinctive understanding of the competing interests of the parties.
