Recent cases

  • D v D (February/October 2023) – this was a three day final hearing followed by a three day appeal before the lead judge of the Bristol Financial Remedy Court.  Nick represented the appellant and the main issue in the appeal concerned the District Judge’s finding as to the relevance of conduct and his approach to the classification of the assets.  The appeal was allowed with costs.
  • W v W (October 2023) – this was a two day final hearing in a long-running case heard in Gloucester.  The main issues in the case were the extent of the wife’s likely inheritance, given negligent drafting of a will, and the relevance or otherwise of pre-marital accrual of the husband’s Armed Forces pension.
  • C v C (February 2023) – this was a final hearing in a case heard in Torquay over four days.  The main issue in the case was whether or not the parties’ property portfolio should be transferred to the husband or sold, in circumstances where the valuations and the amount of capital gains tax payable were disputed.  Nick represented the wife and the case ended with the judge ordering a sale and making a costs order against the husband of £80,000.
  • E v E (February 2023) – this was a final hearing in a farming case heard in Taunton over four days.  The main issue in the case concerned the wife’s desire to buy a farm of her own and the likely receipt by the husband of funds held in trust from a sale by his father of farmland to a national house builder.
  • S v S (September 2022) – this was a final hearing in a case heard in Gloucester over six days.  The main issue in the case was the understanding of the husband’s tax affairs, given he held property via numerous different companies in several tax havens, and whether or not he had truly gambled and lost over £1m on Bitcoin.
  • L v L (May 2022) – this was a PFDR in a case concerning a lottery winner.  Nick’s client had won £10,000 pm for 30 years on the National Lottery.  The issues in the case concerned the true analysis of S v AG and the relevance of the imminent breakdown of the relationship in any event.  The case settled by a lump sum payment of £500,000.
