Sam recently represented the Appellant in appeal against conviction and sentence of being in control of a vehicle whilst over the prescribed limit. This matter was heard in Bristol Crown Court.
Although the statutory defence was not found to be successful, Sam was able to go on and argue grounds for exceptional hardship on the basis of the impact that a driving disqualification would have on other individuals that his client supports in a wider context. This included vulnerable individuals, in both a personal and professional aspect.
The bench returned a finding that Sam’s submissions had passed the threshold of exceptional hardship, and in doing so found that no disqualification was to be imposed in this case.
